2. Scope

These Terms apply to all purchases made by consumers through www.flowerstix.com, subject to the delivery destinations offered at checkout and described on our Customer Info page.

3. Contract Formation

The presentation of products on this website does not constitute a legally binding offer.

To place an order, you add products to your cart, enter your delivery and billing details, choose the shipping and payment method and check all details before you buy. Before submitting your order, you can review and correct your entries at any time – for example, changing quantities, removing items or editing your delivery address – using the tools provided during checkout, or by cancelling the order process altogether.

By clicking the "Buy now" button, you submit a binding offer. A contract is concluded when we confirm the order by email. We save the contract text and send you the order data and these Terms by email. The language of the contract is English.

4. Prices & Taxes

All prices are final prices in EUR unless otherwise stated. Shipping costs are charged in addition to the product prices and are shown before you buy. We are VAT-exempt under the Hungarian small business VAT exemption. Therefore:

No VAT is charged.
No VAT is shown on invoices.

For deliveries outside the EU, you are responsible for any customs duties, import taxes or local charges imposed by your country. We do not collect foreign VAT, sales tax or import duties at checkout.

5. Shipping & Payment

Delivery times, shipping costs and payment methods are described in detail on our Customer Info page. In short:

Delivery times (unless a different delivery time is stated for the product):

EU: approx. 3–5 business days
Outside the EU: approx. 4–10 business days

Delays caused by customs authorities are outside our control. Shipping costs are displayed at checkout before payment. If a product is not available, we will inform you without undue delay and refund any payments already made. We bear the risk of loss or damage in transit until the goods are handed over to you.

Payment is made when you place your order. We do not store full credit card information.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Right of Withdrawal

As a consumer, you have the right to withdraw from this contract within 30 days without giving any reason. We voluntarily extend the statutory withdrawal period of 14 days to 30 days for all consumers.

The withdrawal period expires 30 days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods. If you ordered several goods in one order and they are delivered separately, the period expires 30 days after the day on which you, or a third party indicated by you, acquire physical possession of the last good.

You may use the model withdrawal form below, but it is not obligatory.

You can also withdraw online using the "Withdraw from contract here" function in the footer of our website (withdrawal form). If you use it, we will send you an acknowledgement of receipt on a durable medium (by email), including its content and the date and time of its submission, without undue delay.

To meet the withdrawal deadline, it is sufficient for you to send your notice before the withdrawal period has expired.

Effects of withdrawal If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except for any supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your withdrawal. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier.

You must send back the goods to Batinkov János e.v., Zrínyi u. 211, 1196 Budapest, Hungary, without undue delay and in any event not later than 14 days from the day on which you inform us of your withdrawal. The deadline is met if you send back the goods before the 14-day period has expired. You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

9. Legal Guarantee and Lifetime Guarantee

As a consumer, you benefit from the legal guarantee of conformity, independent of our own guarantee. It covers any lack of conformity that exists at the time of delivery and becomes apparent within 2 years of delivery. If a defect is remedied by repair, this period is extended once by 12 months. Claims under the legal guarantee are free of charge for you, including shipping costs.

Additionally, we offer a voluntary lifetime guarantee against material and manufacturing defects under normal use on products purchased directly from us. This guarantee does not replace or limit your statutory rights – it applies on top of them. Full details, including exclusions and the claim procedure, are on our Customer Info – Guarantee page. Where Hungarian law requires a mandatory warranty (kötelező jótállás) for certain goods, it applies in addition and is not limited by the exclusions of our voluntary guarantee.

10. Liability

Nothing in these Terms excludes or limits our liability for death or personal injury, for loss or damage caused intentionally or by gross negligence, under product liability law, or your statutory rights as a consumer.

11. Force Majeure

We are not liable for any failure or delay in performance to the extent caused by circumstances beyond our reasonable control, including natural disasters, war, labour disputes or government action. This does not affect your statutory rights.

12. Changes to These Terms

We may update these Terms from time to time. Changes do not affect orders already placed – the version in force at the time of your order applies.

13. Severability

If any provision of these Terms is or becomes invalid, the remaining provisions remain unaffected.

15. Complaints and Dispute Resolution

You can send complaints to us by email at hello@xtremestix.com or by post to our address. We will reply to written complaints within 30 days.

If you are a consumer, you may refer a dispute to the conciliation body (békéltető testület) competent for your place of residence or, if you do not live in Hungary, to the Budapest Conciliation Board (Budapesti Békéltető Testület): Krisztina krt. 99. 16. Governing Law

Hungarian law applies to this contract, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, the mandatory provisions of the law of your country of habitual residence remain unaffected.
